Valrico, Florida -- Documents released Monday show the judge has denied the Stand Your Ground motion in the case against Trevor Dooley, the man accused of killing a father in front of his 8-year-old daughter at Valrico neighborhood basketball court.
Dooley, a Hillsborough County bus driver, claims he was walking away from David James during an argument when James came after him and the two ended up on the ground struggling. That's when deputies say Dooley shot James in the chest as they were tussling.
Back in February, James' daughter bravely testified in court on how she saw her dad die in front of her back in November 2010.
Dooley has been charged with Manslaughter, Improper Exhibition of a Firearm and Openly Carrying a Firearm.
The Stand Your Ground law has been in the spotlight after unarmed teenager Trayvon Martin was gunned down in Sanford in February.
